Partner Visas

Partner migration allows the grant of a visa that permits legally married partners, de facto partners and interdependent partners (including those in a same-sex relationship) of Australian citizens, Australian permanent residents or eligible New Zealand citizens to enter and/or to remain permanently in Australia.

Initially, partners who meet the legal criteria for the grant of the visa are granted a temporary visa. Later, a permanent visa may be granted following an eligibility period or, if there is a long-standing relationship, soon after grant of the temporary visa.

Partner migration also allows for the temporary entry to Australia of intended spouses (fiancé(e)s) of Australian citizens, Australian permanent residents or eligible New Zealand citizens.

All applicants for a partner visa must have a sponsor. The sponsor is usually the person with whom the visa applicant has the partner relationship. The sponsor, must meet a range of criteria to be able to sponsor the applicant.

Partner migration is generally a 2-stage process. First, when requirements are met, a temporary Spouse or Interdependency visa will be granted. Subject to some exceptions, two years later, the relationship and other requirements will again be assessed and the applicant considered for a Spouse or Interdependency permanent visa. People intending to marry may apply for a Prospective Marriage visa and will have a 9-month period after they are granted the temporary visa to enter Australia to marry and then apply for a Spouse visa on grounds of their married relationship.

As a part of the partner visa application process, your relationship with your partner will be assessed. The relationship must meet certain criteria for the visa to be issued. You and any of your dependants included in your partner visa application must also meet certain legal criteria before you can be issued a partner visa. These include health and character requirements.
